Makes me glad I'm a CP guy. This is really shameful... you'd think they'd be HAPPY to see their brand(s) on modelers layouts. Oh they're happy... so long as they get their cut. If not... litigation ensues! I understand the need to ensure their logo(s) and color(s) are being reproduced accurately, but this is FAR too heavy-handed. Yeesh.

That Maple Leaf is sure better represented on the Canadian roads than that of the US flag on Utterly Pathetic's grunge-on-wheels... How about 'Milking America'? Or, 'We're a great, big, foolish railroad'? How's 'We will deliver late, over budget, or not at all'? On a serious note, the only yellow on my layout will be the TTX flats, and some other non-You Pee roads...
Apparently, they never heard of FREE advertising pays. It's the word of mouth and us modelers who give them the advertisement on our layouts.
Also, UP may be selling their line in Oklahoma City, due to the GM plant closing down. So, that's another line they are losing.

Actually I don't think our layouts are likely to influance a shipper's decision to use UP As for all of the "bad" press over this trademark issue - that is more likely to have a positive affect on shippers as they see them making a good business decision. Other than that I don't think UP has much competition in the area is serves. Note: My remarks are speculation. I have no facts to support them.
I think we need to donate to the Steamscenes Legal Defense fund... They're fighting back against Useless Pathetic, and they have the UP dancing to drop the suit. Otherwise people need to wise up and not buy UP stuff. Or start sending bills to UP for advertising based on scale miles equipment with the UP logo on it runs at shows or in public view! The mail alone could drive them up the wall and drive the point home. Go Steamscenes!
Greed, greed and more greed! Why do we have to pay them for trademarks that supposedly expires 5 years by Federal law after the parent company has wholly absorbed the company they've purchaed. Supposedly the trademark becomes public domain. And PFE hasn't been around since the 1970s after it was split up into SPFE and UPFE. This company is gone and yet UP claims rights to it. UP's use of the flag is crass marketing taking advantage of the American people and has nothing to do with patriotism. As for who the flag belongs to: If as you say it depends on your active partisipation in the US armed forces then why did you mention your kin folks partisipation. It is irrelevant to your claim. If on the other hand you can "inherit" the possesion to the flag then my fathers preparations to be pre invasion forces, (read one way mission), of Japan would qualify me. Being 4F you would otherwise deny my right to the flag. While I am grateful for your service and sacrifice to and for this nation I disagree with your premis.
